Horse Boarding Agreement

This is a horse boarding agreement between West Fields Ranch, LLC as the boarding facility (referred to as "we" or "us" or "our" ) and

Horse Name ___________ Mare_ Gelding_ Age__ Breed________ Color______Value________

(referred to as " your horse" or "horse"). This agreement spells out the complete understanding between you and us and LIMITS OUR LIABILITY. Our only obligations to you are to provide the things set out in this agreement in good faith when you fulfill your part of this agreement.

TERM AND MONTHLY BOARDING FEE:

The term of this agreement of this agreement is MONTH-TO-MONTH at a rate of $__________ per month. This rate may be changed with at least 15 days notice to you.

BEFORE YOU BRING YOUR HORSE:

Before you bring your horse, you must do the following things:

1) Sign this agreement.

2) Obtain and provide to us a veterinarian's health certificate no more than 30 days old that shows that your horse has no signs of any infectious condition.

3) Verify that your horse is current on all vaccinations and worming.

4) Make the initial payments required.

WHAT WE PROVIDE:

1) We will provide your horse with an outdoor paddock with free choice water and salt block.

3) We will feed your horse 1/4 bale (at least 16 lbs.) of alfalfa hay each day fed half in the morning and half in the afternoon/evening unless otherwise agreed in writing.

3) We will feed additional grains or supplements to your horse that you provide to us with written instructions. There may be an extra fee associated with this service and depends on the frequency of feeding and whether anything needs to be mixed or prepared before it is fed to your horse. Special arrangements need to be made in writing and added to this agreement. There will be no additional charge for feeding supplements if you 1) Buy and stock the supplement, 2) provide a weather proof, easily accessible container near you horses's paddock, 3) provide a scoop that measures the amount you want fed, 4) assume the risk of spoilage, spillage and running out.

4) If we become aware of any injury or illness in your horse that, in our judgment, could require emergency care, we will try to contact you as soon as we can to inform you. Our obligation under this agreement is satisfied if we make good faith efforts to contact you as soon as practical after we become aware of the condition. If for any reason a vet is called by us or anyone else to care for your horse, you agree to be responsible for vet fees.

5) We give you permission to use our riding arena and round pen, as available. You have

permission to park a horse trailer on our facilities on a "space available" basis while you are boarding a horse with us. You agree to park it in the location we direct and to remove it if requested.

YOU AGREE:

1) to pay fees when due,

2) to keep your horse in good health including regular inoculations and worming.

3) to promptly remove any garbage, feed bags, strings, or other items you bring onto our place, (Our garbage service is limited. If you brought it, please take it away with you.)

4) not to spread straw, shavings, or any other materials in the paddocks without express permission and to remove any material you do spread as soon as it is soiled or when requested,

and

5) not to store vehicles, materials, supplies, or other items on our place without express permission and to remove them promptly when requested.

LIABILITY LIMITATIONS AND OTHER PROVISIONS

1) WFR is not liable for inherent risks of equine and livestock activities as defined in 78-27b-101, Utah Code:

"Inherent risk" with regard to equine or livestock activities means those dangers or conditions which are an integral part of equine or livestock activities, which may include:

(a) the propensity of the animal to behave in ways that may result in injury, harm, or death to persons on or around them;

(b) the unpredictability of the animal's reaction to outside stimulation such as sounds, sudden movement, and unfamiliar objects, persons, or other animals;

(d) the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within his or her ability.

2) You agree to be responsible and liable for any injury or damage caused by you, your horse, or your guests to any person, to our property or to the property of anyone else.

3) You agree to use these facilities in an "as is" condition and assume the risk and responsibility for you and your guests safety. We make no warranty regarding the condition or the fitness of any of our facilities for any purpose beyond boarding your horses. Our facilities are not locked and you agree to use them or to leave your property at our facilities at your own risk.

4) You agree to be particularly careful with any children that you bring or that come as your guests to our facility. You agree to insure that young children (under 13 years of age) are at all times in the immediate presence of an adult and have close, watchful supervision. WIRE FENCES may be CHARGED WITH ELECTRICITY and will SHOCK anyone who touches them. Keep children from touching the wire fences or entering the stalls of other horses.

5) You agree not to invite or allow guests to come to our facility or to handle your horse without you being present unless we have received a properly signed liability waiver on WFR's release form for each guest who comes when you are not present.

6) If you invite, bring, or allow guests onto our facilities or allow any others to handle your horse, you agree to indemnify us, our family members and employees (pay any amounts we might otherwise be required to pay) for any liability to them for any injury incurred at our facilities or resulting from their participation in any activities associated with WFR or on our premises.

7) You warrant (guarantee) that you are the owner of the horse you are boarding with us and that you have full rights to the horse and authority to enter into this agreement. You agree to indemnify us for any costs or consequences arising because you are found not to be the full owner of the horse.

8) We are not responsible for damages to you or your horse from causes not within our control.

9) While we live on the premises, we are not always here and we do not always know all the people who come onto the boarding facilities. The facilities and premises are not locked. We are not responsible for the loss or injury to your horse or other property caused by others who board horses here or who come onto our premises for any reason what so ever.

TERMINATION OF THIS AGREEMENT:

This agreement may be terminated for any reason by either party with a minimum of 30 days written notice to the other. If you remove your horse without sufficient notice, you will continue to owe boarding fees for 30 days after you remove your horse or give notice, which ever is earlier.

Immediate termination: This agreement may be terminated immediately by sending a written notice by certified mail 1) for breach of this agreement including failure to pay amounts when due or 2) when, in the judgment of WFR, you, your horse or your guests pose a threat to the peaceful enjoyment of the ranch or a threat to the health or safety of other horses, owners or guests. Termination is complete the day after the notice is placed in the mail.

All amounts due but unpaid under this contract at the time of termination may still be collected after termination of the contract as well as additional boarding fees and late fees until your horse is actually removed from our facilities and all amounts due are paid.

LATE FEES AND CONSEQUENCES:

The boarding fee is due on the 1^st day of each month. A late fee of $15 per horse is due after the 1^st. An additional late fee of $50 per horse is due if the boarding fee is not fully paid within 30 days after due. If any boarding fees remain unpaid for 60 days, or if you leave your horse here more than 5 days after the termination of this agreement, you authorize us as a non-exclusive remedy, without further notice to you, to sell your horse in any way we see fit to pay any amounts due and to give the buyer free and clear title to your horse.
