In consideration for WFR allowing MY CHILD to RIDE, I agree to provide insurance to cover any injury that may occur during any of the activities associated with a RIDE. I agree to accept the proceeds, even if $0, of such insurance as full and complete compensation for myself and for and on behalf of my child for any injury. I agree to indemnify WFR for any consequence of failing to provide insurance or failing to provide sufficient insurance to adequately cover any such injury. WFR is not liable for inherent risks of equine activity as defined in 78- 27a-101, Utah Code:
"Inherent risk" with regard to equine or livestock activities means those dangers or conditions which are an integral part of equine or livestock activities, which may include:
(a) the propensity of the animal to behave in ways that may result in injury, harm, or death to persons on or around them;
(b) the unpredictability of the animal's reaction to outside stimulation such as sounds, sudden movement, and unfamiliar objects, persons, or other animals;
(c) collisions with other animals or objects; or
(d) the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within his or her ability.
I recognize that horses can be excitable, difficult to control and unpredictable; that horses can shy, bite, kick, buck or run away suddenly and unexpectedly; that accidents and unexpected events can happen to anyone at anytime. I understand that the ground can be slippery or uneven with various obstacles seen and unseen. I understand that WFR does not have trained first aid responders nor extensive first aid supplies.
Recommended Clothing and Equipment for Horse Riding: I understand that the following items are recommended for horse riding: Helmet with proper fit, Boots with a heel, Long pants, Gloves.
WFR has a variety of sizes of Helmets but does not provide any of the other clothing or equipment. I agree to be responsible for choosing a helmet for MY CHILD that fits properly or to provide my own helmet if they do not have one that fits properly. I assume all risk and responsibility if I do not provide a properly fitting helmet or if my child does not wear one.
I take full responsibility and assume all risks associated with MY CHILD participating in any RIDE or related activities. I take full responsibility for MY CHILD's ability to handle safely any circumstance MY CHILD encounters on such a RIDE or related activities. I will hold WFR, Byron Harward and all members of his family and any others that assist WFR in these activities harmless and blameless for any injury or loss to MY CHILD, myself or my property which occurs while participating in a RIDE or related activities and agree to indemnify them (pay them back) for any damage, cost or liability that they may incurr in connection with MY CHILD's participation.
THIS AGREEMENT IS CONTINUING and is consideration for WFR allowing MY CHILD to participate in any future rides or related activities where MY CHILD rides or uses WFR's horses, equipment or facilities.
